and where the gates and doors in such barriers are not self-closing and self-latching and where  
the self-latching device is less than 54 inches (1372 mm) above the bottom of the gate, and  
where the release mechanism is not located on the pool side of the gate. Exception: Spas or  
hot tubs with a safety cover that complies with American Society for Testing Materials (ASTMF)  
1346, as may be amended or replaced.
