Background:

On June 25, 2024, the Board of County Commissioners approved the Reagan Center PD Major Amendment Rezone (“Project”) and Development Order 23-20500017 (“DO”) for property in District 2. The DO included requirements and conditions of utility service for each Development Phase of the Project. Among the DO conditions were requirements for certain capacity improvements to be installed prior to each phase of development and for the developer to pay a proportionate share of these improvements.

PRM Integra/Seminole Owner LLC (Developer) has applied to permit and develop Phase I of the Project which includes 326 multifamily dwelling units and a clubhouse. As provided in the DO, an existing County sanitary sewer pump station, located in District 4 and identified as Hampton Park Master Pump Station (“HPM”), must be upgraded prior to completion of Phase I to handle the anticipated increase of wastewater flow to HPM.

Jacobs Engineering, on behalf of the County (“Engineer”), has prepared a preliminary design report and is currently preparing the engineering plans and specifications to upgrade HPM. Staff have included $4.5 million in the proposed FY 26 CIP budget (Project 02608051) for the construction of HPM based on preliminary engineering estimates.

Consistent with the DO, the proposed Utilities Agreement, in addition to the standard provisions regarding developer’s connection to County utilities, provides the following:

1.                     Developer must pay either the water connection fee, or the proportionate share of projected water system improvements, whichever is greater, to reserve water capacity ;

2.                     Developer must pay either the wastewater connection fee, or the proportionate share of projected wastewater system improvements, whichever is greater , to reserve wastewater capacity;

3.                     Developer will contract to construct HPM in accordance with the plans and specifications prepared by Engineer;

4.                     The County will reimburse Developer for the costs associated with the construction of HPM upgrades using the Developer’s proportionate share for wastewater capacity improvements and supplementing with other budgeted funds;

5.                     Detailed responsibilities and processes related to the construction of HPM upgrades;

6.                     Procedures for conveyance of installed improvements, easements and property to the County for public use.

The DO provides the option  of allowing the Developer to construct  the HPM upgrades, which gives the Developer a measure of control over the timing of the project and the construction schedule. Construction of the HPM is a  prerequisite of certificate of occupancy issuance. Additionally, County and Developer will be stakeholders in the costs associated with said construction.  

The Utilities Agreement will only authorize the aforementioned provisions directly related to water and wastewater capacity, connections to County utilities, and upgrades of HPM. The Agreement does not authorize any other aspect of construction related to the Project. 

Requested Action:

Staff requests that the Board approve and authorize the Chairman to execute the Conditional Utilities Agreement for Water, Wastewater, or Reclaimed Water Services for the Reagan Center Phase I Development.
