Background:

On July 23, 2025, Tiffany Wolgast filed a Complaint against Seminole County in Circuit Court for replevin relating to the impoundment of her dog. Section 20.37(c) of the Code of Ordinances provides that the Animal Services Division cannot release impounded animals if their owners have unpaid citations. Ms. Wolgast currently owes $1,920.00 for 15 citations issued by the Animal Services Division for various violations of the County’s Animal Control Ordinance.  At Ms. Wolgast’s request, these citations have all been subject to hearings in County Court, and the fines imposed by the Court are currently delinquent. The negotiated Settlement Agreement and Release (“Agreement”) requires Ms. Wolgast to enter into a payment plan with the Clerk of the Court’s Office to satisfy these fines.  In addition, Ms. Wolgast is required to remit the impound and rabies fees to the County, and to voluntarily dismiss the replevin lawsuit.  Upon Ms. Wolgast’s completion of her obligations under the Agreement, the County will waive all per diem boarding fees and release the dog to Ms. Wolgast. The Agreement also provides that Ms. Wolgast releases and forever discharges the County from any claims or liabilities related to the replevin lawsuit and the underlying facts of the case.

Requested Action:

Staff requests the Board approve and authorize the Chairman to execute the Settlement Agreement and Release proposed in the matter of Tiffany A. Wolgast vs. Seminole County (Case No.: 2025-CA-001655).
