Background:
In accordance with Section 35.152 of the Seminole County Land Development Code (SCLDC), the Applicant is requesting Board approval of the Magnolia Plantation Driving Range Final Plat. The plat contains one (1) lot on 3.44 acres. The subject site has a Planned Development Future Land Use designation and a PD (Planned Development) zoning classification.
August 28, 1990, a rezone from A-1 (Agriculture) to PD (Planned Development) for the Magnolia Plantation PD (fka Bent Tree Golf and Country Club PD) was approved by the Board of County Commissioners. Districts 1, 2, 3, 4 and 5 voted AYE.
On May 12, 2022, the PD was amended administratively to establish the boundary for proposed Lot 1 with permitted uses, development criteria, and legal access to the existing Bender Academy facility that’s located on proposed Lot 1. The proposed replat seeks to create a legal subdivision of land that will allow for the separation of ownership between the Bender Academy facility and the adjacent Magnolia Plantation Golf Course.
Lot 1 will access onto Shadowmoss Circle, which is a private right-of-way within the Magnolia Plantation Subdivision, via a twenty (20) foot wide drive aisle.
The site is located within the Seminole County utility service area. The existing building located on proposed Lot 1 is currently connected to public utilities for water and utilizes a septic system for waste-water due to sewer lines not being in proximity to the building.
The proposed plat does not require a performance bond because infrastructure is already existing.
The plat meets all conditions stated in Development Order #90-0613, Developer’s Commitment Agreement #22-20500004, and all applicable requirements of Chapter 35 of the SCLDC and Chapter 177, Florida Statutes.

Staff requests the Board of County Commissioners approve the Final Plat for the Magnolia Plantation Driving Range Subdivision containing one (1) lot on 3.44 acres zoned PD (Planned Development), located on the north side of Shadowmoss Circle, one (1) mile west of Markham Woods Road.
