Background:

The Applicant has petitioned the County to vacate and abandon an uncut portion of the public right-of-way known as Toula Avenue of the Des Pinar Acres Subdivision, as recorded in Plat Book 12, Page 52, of the Public Records of Seminole County, Florida.

The Applicant owns both parcels adjacent to the north and south of the right-of-way subject to this vacate and proposes to incorporate the subject's sixty-six (66) foot wide right-of-way into their property as part of a future proposed development. There is an existing private access/billboard easement that is by and between Greater Properties, Inc. and Landmark Infrastructure Holding Company, LLC, located within the uncut portion of right-of-way which will remain intact at this time. The right-of-way was intended for development of a cul-du-sac; however, it does not provide access to any surrounding properties. The abandonment of this right-of-way, therefore, will not result in any parcels being landlocked.

The Applicant has provided letters of no objection from all applicable utility companies and Public Works has no objection to the requested vacate. At the request of the Sunshine Water utility company, the Applicant has provided a utility easement agreement for the subject property.

Staff has confirmed with County Greenways & Natural Lands Division that there are no plans for the use of this right-of-way.

This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Land Development Code and the authority of Sections 336.09 and 336.10, Florida Statutes.

In pursuant of F.S. 336.10 a notice was published at least fifteen (15) days prior to this public hearing.

Requested Action:

Staff requests the Board adopt the Resolution vacating and abandoning an uncut portion of the public right-of-way known as Toula Avenue, as recorded in Plat Book 12, Page 52, of the Public Records of Seminole County, Florida.
