*For parcels 115 and 118, an agreement has been reached with the owner on compensation, but the mortgage lender has not signed a joinder and consent, necessitating an eminent domain action on these parcels.

Staff directed the County Attorney’s Office and the County outside eminent domain counsel to obtain updated appraisals of these properties that are needed before the County obtains title to the property and property interests identified in this memorandum.  Consequently, the appraised values listed in the preceding table may be subject to change.

In addition, staff requests the Board consider, adopt and authorize the Chairman to execute a Resolution of Necessity finding that the construction of the Hillview Drive Drainage Improvement Project is necessary, serves a County and public purpose and is in the best interest of the citizens of Seminole County and requesting authority for the County Attorney's Office or its designee: (1) to negotiate in good faith with the owners of the parcels, (2) to make all necessary binding offers consistent with the authority granted by the Board of County Commissioners prior to institution of condemnation proceedings and, (3) if necessary, to file condemnation proceedings to exercise the power of eminent domain to acquire the subject parcels.
