Background:
The Applicants were cited by Code Enforcement for installing a storage shed without first obtaining permits. As a step towards obtaining compliance, they have petitioned Seminole County to vacate a portion of a fifteen (15) foot wide platted utility easement along the east perimeter of Lot 113 of the Trailwood Estates Section 1 Subdivision, as recorded in Plat Book 16, Page 28 of the Public Records of Seminole County, Florida. The subject utility easement was originally platted as a fifteen (15) foot wide utility easement.
The area subject to the vacate request is a portion of the west twelve (12) feet of the fifteen (15) foot utility easement that runs along the east property boundary of Lot 113, being one hundred fourteen point ten (114.10) feet in length, for a total of 1,327.13 square feet.
The Applicant is requesting the partial vacation of a fifteen (15) foot wide utility easement to accommodate an existing above ground pool with a concrete base and two (2) existing sheds. The structures encroach twelve (12) feet into the easement; leaving three (3) feet intact along the eastern property boundary.
The Applicant must obtain approval of a variance for the existing above ground pool and the two (2) sheds if the structures do not comply with the applicable property setbacks. Otherwise, the structures must be relocated to meet the required setbacks.
The property is located in the R-1A (Single Family Dwelling) zoning district. The applicable setbacks for accessory structures, including the above-ground pool and sheds, are ten (10) feet from the rear property line and five (5) feet from the side property lines.
To retain the structures in the current locations, the Applicant must also obtain variances to reduce the side yard setback along the southern property line from five (5) feet to three (3) feet and the rear yard setback from ten (10) feet to three (3) feet. The applicant must complete the easement vacation process before applying for the variances.
The Applicant has provided letters of no objection from all applicable utility companies and Seminole County staff has no objections to the partial vacation and abandonment of the drainage and utility easement as requested.
This request complies with the requirements for vacating easements under the authority of Section 35.181, Land Development Code of Seminole County, and Section 177.101 of the Florida Statutes.
