Background:

The Applicant is proposing to reconstruct an existing 3,044.8 square foot boat dock/house/walkway. The boat dock/house terminal platform is 874 square feet and the four (4) foot wide walkway from the lake shore to the terminal platform is 542.7 feet in length and 2,170.8 square feet in area.

 

Sylvan Lake is a shallow lake, with a mean depth of seven (7) feet and a maximum depth of sixteen (16) feet.

 

This boat dock/house does not qualify for the exemption listed in Sec.70.5 of the Seminole County Land Development Code.  Subsection 70.5(a)(3) allows for an exemption of existing docks being rebuilt, but the original boat dock/house did not have an approved dredge and fill permit, therefore the exemption is not applicable.

 

Section 70.6(g) of the Land Development Code of Seminole County (LDC) requires a public hearing before the Board of County Commissioners on requests for boat docks and unenclosed boat houses and gazebos alone, or in any combination in which the total aggregate size is 1,000 square feet or more. Since the total aggregate size of the boat dock/house/walkway is 3,044.8 square feet, this request is required to go to the Board of County Commissioners for consideration and approval.

 

In reviewing this request, Section 70.7 of the LDC requires the Board to consider the following items prior to granting or denying the request (italicized text indicates the response and analysis):

 

a)                     Turbidity in streams, wetlands, and estuarine areas must be minimized.

Turbidity barriers are required to contain the impacts of construction and will be required to be shown on the Site Plan at the time the building permit application is submitted.

 

b)                     The possible effect on the quality of waters on the County.

As the surface area of Sylvan Lake is 188 acres and the proposed construction of the new dock will be 542.7 feet +/- from the shoreline of the subject property, any additional impact on water quality, if any, should be minimal as the dock is being reconstructed to the same size and shape of the existing structures.

 

c)                     The possible effect on the propagation of wildlife, fish, and aquatic plants and animals.

Sylvan Lake at 188 acres, provides an adequate environment for the propagation of wildlife, fish, aquatic plants, and animals. Thus, any possible effect would be minimal.

 

d)                     The possible effect on all property owners fronting the body of water involved.

The shoreline of the subject lot is 125 feet +/- wide.  The dock walkway is placed approximately in the center of the lot making it 60 +/- feet from the neighboring properties to the north and south. The boat house will also meet the ten (10) foot height to the ridge line of the roof and ten-foot (10) side yards setback requirement. Thus, there will be minimal impacts on other property owners. (Exhibits A & B)

 

e)                     The possible effect upon the public health, safety, comfort, good order, appearance, prosperity, and general welfare.

For the reasons noted above, there should be no negative effect upon the public health, safety, comfort, good order, appearance, prosperity, and general welfare of the area.

 

f)                     The recommendations of any governmental and/or professional agencies.

The Applicant was issued a self-certification letter (i.e. an exemption from a general use permit) for the reconstruction of the boat dock/house from the Florida Department of Environmental Protection. (Exhibit C)

 

g)                     The possible effect upon the safe navigation of vessels and watercraft.

The opposite shoreline is approximately 2,695 feet +/- away, and the length of the proposed boat dock/house is approximately 542.7 feet +/- waterward of the mean high-water line.  The proposed boat dock meets the code requirement of projecting not more than twenty-five percent (25%) of the width of the water body and, therefore, does not create a navigational hazard.

 

Requested Action:

Staff requests the Board approve the request for a 3,044.8 square foot boat dock/house/walkway on Sylvan Lake, located on the west side of Sylvan Woods Drive, approximately 2,730 feet south of State Road 46, more particularly known as 6699 Sylvan Woods Drive.
