Background:

On May 23, 2023, and on August 8, 2023, the Seminole County Board of County Commissioners determined that an unoccupied structure and pool at 1655 EE Williamson Road, Longwood, were unsuitable for occupancy; dangerous and unsafe; a fire hazard; and a hazard to the safety or health of the general public, all by reason of inadequate maintenance, dilapidation and abandonment. On August 8, 2023, the Chairman of the Seminole County Board of County Commissioners executed an ‘Amended Notice of Determination of Public Nuisance’ which scheduled a public hearing on September 12, 2023.  

At the September 12, 2023, public hearing, the Board approved a Resolution issuing an Order to declare the existence of a public nuisance at 1655 EE Williamson Road, Longwood and requiring corrective action to be taken by the record property owners to abate the public nuisance by October 12, 2023.  The Board further ordered that in the event the nuisance was not abated by the record property owners by October 12, 2023, the Board authorized Seminole County Staff to perform such required corrective action and to assess the costs incurred against the record property owners as a lien. 

No action was taken by the record property owners by October 12, 2023. The County initiated the abatement of the nuisance structure and pool on January 13, 2024, and the nuisance conditions on the property were fully abated by the County on April 17, 2024.

As provided in Seminole County Code, Section 168.10, as Seminole County took corrective action to abate the public nuisance, the cost of such action, together with the cost incurred in the administration of the public nuisance certification, the searching of the public records to determine ownership, and in serving the notice(s), will all be assessed against the record property owners of the affected property and, if payment of these costs are not received, such will be recorded as a Certificate of Costs of Abatement lien against the subject property. As of June 7, 2024, no payment for any of the costs incurred was received by the County.

On June 7, 2024, the Seminole County Director of Development Services certified the costs that were incurred in abating the public nuisance. A copy of this certification was sent by certified mail to the record property owners at the last known address, which constituted a demand for the payment of such costs to be paid within fifteen (15) days from the date of mailing.

Pursuant to Chapter 168, Seminole County Code, Staff is requesting that the Board: (1) approve the certified costs incurred by the County in the amount of $164,887.25, to abate the unoccupied structure and pool located at 1655 EE Williamson Road, Longwood, as specified in Section 168.8 (a); and (2) impose the Certificate of Costs of Abatement as a lien against the property.

Staff requests the Board approve and authorize the Chairman to execute an Order imposing a lien for the cost of public nuisance abatement against the property at 1655 EE Williamson Road, Longwood, for the abatement costs incurred by the County in the amount of $164,887.25.
