Background:

The Applicants Candice S. Powell and Jeanice R. Powell have petitioned Seminole County to vacate and abandon five (5) feet of a fifteen (15) foot wide utility easement established along the west perimeter of the Lakeview Village Subdivision recorded in Plat Book 38, Pages 86-89 of the Public Records of Seminole County, Florida. 

The area subject to the vacate request is five (5) feet in width and thirty-eight (38) in length, being approximately 190 square feet. The existing single family residence currently encroaches five (5) feet within the fifteen (15) foot wide utility easement. The purpose of the requested vacate is to rectify the encroachment.

The Applicants have provided letters of no objection from all applicable utility companies and Seminole County staff has no objections to the request to vacate.

This request complies with the requirements for vacating easements under the authority of Section 35.184(b), of the Seminole County Land Development Code and Section 177.101, Florida State Statutes.

 

Requested Action:

Staff requests the Board adopt the Resolution vacating abandoning a portion of a fifteen (15) foot wide utility easement on Lot 17 of the Lakeview Village Subdivision, as recorded in the Plat Book 38, Pages 86 - 89 of the Public Records of Seminole County, Florida, for property more particularly known as 302 Lakebreeze Circle, Lake Mary.
