Background:

The Applicant is requesting to vacate a seven-and-one-half (7.5) foot-wide platted utility easement along the northwest side of Lot 29 of the Big Tree Crossing Phase 1 Subdivision, as recorded in Plat Book 27, Pages 20 and 21 of the Public Records of Seminole County. The area subject to the requested vacate is seven-and-one-half (7.5) feet in width and 142.6 feet in length, containing approximately 1,069.5 square feet.

The purpose of the request is to accommodate storage containers in the rear yard of the property. On January 26, 2026, the applicant secured approval of a rear yard setback variance for the storage containers from the required ten (10) foot setback to zero (0) feet in the M-1 (Industrial) zoning district. The proposed vacate would allow the applicant to move forward with permitting the containers.

The Applicant has provided letters of no objection to the vacation of a portion of the utility easement from all applicable utility companies.  County staff has no objections to the partial vacation and abandonment of the utility easement.

This request complies with the requirements for vacating easements under the authority of Section 35.181, Land Development Code of Seminole County, and Section 177.101 of the Florida Statutes.

Requested Action:

Staff requests the Board adopt the Resolution vacating and abandoning a utility easement located on Lot 29 of the Big Tree Crossing Phase 1 Subdivision, as recorded in Plat Book 27, Pages 20 and 21 of the Public Records of Seminole County.
