Background:

Staff requests authorization from the Board to make a binding written offer to the owners of Parcel 800 to be acquired for the Nebraska Avenue Bridge Safety Improvement Project in the recommended amounts listed in the chart below.

The proposed offer is the same as the latest offer that the County has made, subject to Board approval, to the property owners during the voluntary acquisition process. The County Attorney’s Office concurs with the proposed offer amount.

In addition, staff requests the Board consider and adopt and authorize the Chairman to execute a Resolution of Necessity, prepared by the County Attorney’s Office, finding that the construction of the Nebraska Avenue Bridge Safety Improvement Project is necessary, serves a County and public purpose and is in the best interest of the citizens of Seminole County and requesting authority for the County Attorney's Office (1) to negotiate in good faith with the owners of the parcels, (2) to make all necessary binding offers consistent with the authority granted by the Board of County Commissioners prior to institution of condemnation proceedings and, (3) if necessary, to file condemnation proceedings to exercise the power of eminent domain to acquire the subject parcels.

Requested Action:

Staff requests the Board authorize the making of a binding written offer to the owners of Parcel 800 in the amount listed in this memorandum and adopt and authorize the Chairman to execute the proposed Resolution of Necessity as to Parcel 800 of the Nebraska Avenue Bridge Safety Improvement Project.
