Background:

In accordance with Section 35.152, Seminole County Land Development Code (SCLDC), the Applicant is requesting Board approval of the Final Plat for the West Orange Subdivision. In 2006, the property was subdivided by way of warranty deed without seeking County approval to create a new parcel consisting of Lot 21 and a portion of Lot 22. The remainder of Lot 22 was combined with Lots 23 and 24. The subdivision of these two parcels created two non-conforming parcels that do not meet the required minimum width and lot size requirements for the A-1 (Agriculture) zoning designation. The Applicant was required to Rezone the subject property from A-1 (Agriculture) to R-1A (Single Family Dwelling) to meet the minimum width and lot size of the R-1A zoning designation.

On April 25, 2023, a Rezone from A-1 (Agriculture) to R-1A (Single Family Dwelling) for the subject property was approved by the Board of County Commissioners.

Districts 1, 2, 3, 4, 5 voted AYE.

The Applicant was required to replat the subject property to legalize the parcel to construct one (1) single family residence.

The development is located within the Seminole County water service area. The nearest sewer connection is approximately ½ mile north of the subject property; therefore, the developer will utilize an advanced septic system for wastewater.

The Applicant has provided all required submittals as per Section 35.44 of the SCLDC. Staff has reviewed the required submittals and finds that the request complies with all applicable provisions of Chapter 35 of the SCLDC, Chapter 177, F.S. and the land use and zoning designation of the property.

Requested Action:

Staff requests the Board of County Commissioners approve the Final Plat for the West Orange Subdivision containing one (1) lot on approximately 0.25 acres zoned R-1A (Single Family Dwelling), located on the north side of W Orange Street, approximately 200 feet west of Laura Avenue.
