Background:
The Florida Department of Transportation, as part of its development of the truck parking facility near the intersection of School Street and Monroe Boulevard (“Project”), FDOT FPN 446445-1, desires to begin road and utility work within the School Street right-of-way. Since School Street is a County road at this time, FDOT requires authorization from the County to begin work within the right-of-way. However, FDOT plans to request jurisdictional transfer of School Street from the County to FDOT in the near future.
In summary, the proposed Off-System Construction and Maintenance Agreement does the following:
1) Gives FDOT a right of entry to begin work within the School Street right-of-way.
2) Authorizes FDOT to complete necessary work on County utility facilities within the limits of the Project.
3) Requires FDOT to provide a one-year warranty on the utility work completed.
4) Requires the County to be listed as an additional insured on FDOT’s contractor’s insurance policy.
5) Requires FDOT and County to work together to effectuate the ownership and jurisdictional transfer of School Street from the County to FDOT proposes that Seminole County transfer the ownership and jurisdiction of School Street between US 17-92 and Elder Road due to the increase in truck traffic caused by the new Truck Stop so that the burden of maintaining the road under these heightened traffic conditions, which are a result of the Department’s development of the Truck Stop, falls to the Department instead of the County.
Requested Action:
Staff requests the Board approve and authorize for the Chairman to sign the Off-System Construction and Maintenance Agreement between the Florida Department of Transportation and Seminole County and the corresponding resolution to authorize and allow FDOT to begin work on the School Street right-of-way and on County utility facilities, between US 17-92 (Monroe Road) and Elder Road, prior to jurisdictional transfer of School Street from Seminole County to FDOT.
