Background:

The Applicants have petitioned the County to vacate two (2) platted utility easements on Lot 38 and Lot 39 of the Wingfield North Partial Replat, as recorded in Plat Book 50, Page 72, of the Public Records of Seminole County Florida.

Lots 38 and 39 of the Wingfield North Partial Replat were originally included in the Wingfield North Plat approved in 1981. Lot 38 was platted with a five (5) foot wide utility easement along the east perimeter, and Lot 39 was platted with a five (5) foot wide utility easement along the west perimeter. In 2015 both lots were subject to the Wingfield North Partial Replat for the purpose of reconfiguring the adjoining lot line between the two lots; however, the platted utility easements were not adjusted to follow the new lot line which resulted in an encumbrance on a portion of reconfigured Lot 39. The aggregate square footage of the two (2) utility easements is approximately 2,275 square feet.

The Applicant has provided letters of no objection from all applicable utility companies and Seminole County staff has no objections to the vacation and abandonment of the utility easement as requested.

This request complies with the requirements for vacating easements under the authority of Section 35.181 of the Seminole County Land Development Code, and Section 177.101 of the Florida Statutes.

Requested Action:

Staff requests the Board approve and authorize the Chairman to execute a Resolution vacating and abandoning two (2) platted utility easements located on Lot 38 and Lot 39 of the Wingfield North Partial Replat of Lots 38 & 39 as recorded in Plat Book 50, Page 72, of the Public Records of Seminole County, Florida, more particularly known as 2820 Jacana Ct, Longwood.
