Background:

To assist with funding for compliance with the United States Environmental Protection Agency’s (EPA) Lead and Copper Rule Revisions (LCRR), promulgated in 2021 in Title 40 Code of Federal Regulations, Part 141, Subpart I, the Board of County Commissioners authorized a loan agreement (LS590220) with the Florida Department of Environmental Protection (FDEP) in November of 2024. The agreement provided funding to the County for a drinking water infrastructure project that included the identification of approximately 14,500 unknown water service line materials, development of an initial service line materials inventory, preparation of a service line replacement plan and compliance with other applicable regulatory requirements.

The total loan award amount was $1,140,000 with 49% forgiveness and 51% to be repaid over ten years (starting April 15, 2029) at 0% interest. The County Utilities Department has completed the inventory, has submitted the requisite documents to FDEP and is awaiting FDEP approval. Lead service lines were not identified within, or connected to the County’s Utility, so the County has only needed to request reimbursement of $345,458.34.

The County has received a request from FDEP to amend the agreement with updated terms from EPA, including but not limited to, language addressing discrimination, public information, and construction requirements. The Utilities Department has no objections to EPA’s updated terms and does not anticipate construction related to this project pending FDEP approval of submitted reports.

The amendment has been reviewed by the County Attorney’s Office and is approved as to form and legal sufficiency.

Staff requests the Board approve and authorize the Chairman to execute the State Revolving Fund Amendment 1 to Loan Agreement LS590220 - Seminole County.
