Background:

On December 12, 2017, the Board of County Commissioners (BCC) approved the lease agreement for a 2,100 square foot warehouse storage space at the Brio Business Center at 1271 West Airport Blvd, Sanford, FL 32773. On August 25, 2020, the BCC approved the First Amendment to the lease agreement which added temporary suite 1241 containing 1,875 square feet of storage space. On May 25, 2021, the BCC approved the Second Amendment to the lease agreement, which terminated the temporary suite 1241 and added suite 1275, containing 2,100 square feet of storage space for a total of 4,200 square feet (suites 1271 and 1275). Suites 1271 and 1275 are utilized by Emergency Management for storage of emergency management supplies and other equipment/materials. The current lease matures on December 31, 2024.

 

The proposed Third Amendment and Final Renewal renew the lease for the final three (3) years from January 1, 2025, to December 31, 2027, with an option to terminate the lease early with a 180 days written notice. Any reference to the Landlord is updated to Juanita Mobile Home Park, LLC d/b/a Brio Business Center, LLC, as per the assignment and assumption of leases dated December 21, 2021. Lease rent increases to $3,293.74 starting January 1, 2025, which results in an annual increase of $1,151.16 for a total of $39,524.88. The Landlord continues to be responsible for all exterior maintenance, water/sewer charges and garbage collection. The County is responsible for all interior maintenance, pest control, and electricity costs.

Requested Action:

Staff requests the Board approve and authorize the Chairman to execute the Third Amendment and Final Renewal to Lease Agreement - Brio, LLC and Seminole County.
