Background:

The Applicant is requesting to vacate a portion of a seven-and-one-half (7.5) foot-wide platted utility, drainage, and sidewalk easement along the south side of Lot 62 of the Bristol Park Subdivision as recorded in Plat Book 29, Pages 79 to 81 of the Public Records of Seminole County, Florida. The subject area of the vacate request is more particularly known as the east forty-eight (48) feet and six (6) inches of the south seven and one half (7.5) feet of said utility, drainage, and sidewalk easement. The area to be vacated contains approximately 360 square feet and six (6) square inches.

The purpose of the requested partial utility, drainage, and sidewalk easement vacate is to allow for the rebuilding and extension of an existing wall along the south side of the property and for the placement of pool equipment along the wall of the existing accessory building to the south.

The Applicant has provided letters of no objection from all applicable utility companies. The applicant has also provided approval from the Heathrow Master Design Review Board and Bristol Park Neighborhood Committee. Seminole County staff has no objections to the partial vacation and abandonment of the utility, drainage, and sidewalk easement. 

This request complies with the requirements for vacating easements under the authority of Section 35.184(b), Land Development Code of Seminole County.

Requested Action:

Staff requests the Board adopt the Resolution vacating and abandoning a portion of a utility, drainage, and sidewalk easement located on Lot 62 of the Bristol Park Subdivision, as recorded in Plat Book 29, Pages 79 to 81 of the Public Records of Seminole County, Florida.
