Background:
During its 2026 session, the Florida legislature passed House bills 399 and 803, which generally requires that development fees reflect the actual cost of providing services associated with such permits. House bill 803 specifically sets forth a deadline for compliance of July 1, 2026. Since this deadline precedes the ordinary budget process, it is necessary to provide the Building Official and Development Services Director a reasonable amount of latitude to adjust fees to ensure they reflect the actual costs contemplated by the Statute. This Resolution provides for the delegation of temporary authority to the Building Official to establish inspection fees and building permit fees; and delegation of temporary authority to the Development Services Director to establish Development Permit and Development Order application fees. In order to further comply with the State mandate, county staff has requested budget authorization in FY 26-27 to conduct a study of all development fees to ensure compliance with the State requirements and make appropriate adjustments to be reflected in the County’s published fee schedule once approved by the Board of County Commissioners. The Resolution provides for the termination of temporary authority upon adoption of the approved schedule.
Requested Action:
Staff requests the Board approve and authorize the Chairman to execute a resolution delegating temporary authority to the Building Official and the Development Services Director to establish fees pursuant to legislative changes
