Background:
The property located at 1101 E. Broadway Street is developed with a one-story office building and is in the City of Oviedo. The site subject to the Development Order (DO) and Cross Access Easement Agreement is located on the north side of E. Broadway Street (aka CR 419), east of Reed Avenue.
The DO and Cross Access Easement Agreement, which date back to 1990, were required as part of a Right of Way Utilization Permit for a driveway access onto CR 419. The DO and Cross Access Easement Agreement contemplated that the adjacent properties to the west and east would use the driveway to CR 419 on this property for access. This did not occur, as both of those properties are now developed with independent driveways onto CR 429 and cannot connect to the cross-easement areas that were originally reserved.
The County Engineer, Tony Nelson, has reviewed the existing driveways and cross access tied to the property and agrees that the cross-access easements are no longer practical and supports the request from Dave Axel on behalf of Khov RE Holdings, Inc. to release the DO and Cross Access Easement Agreement.
