Background:
The Applicant has petitioned the County to vacate and abandon a portion of an undeveloped right-of-way known as Turkey Avenue, lying adjacent to the north perimeter of Lot 3 of the Swopes Amended Plat of Iowa City, as recorded in Plat Book 6, Page 96 of the Public Records of Seminole County, Florida.
The area to be vacated is approximately 652 feet in length and thirty (30) feet in width, being approximately 19,580 square feet. Turkey Avenue is located on the perimeter of the Swopes Amended Plat of Iowa City; therefore, the entirety of the right-of-way, if vacated, will be conveyed to Lot 3. The Applicant owns Lot 3 as well as the properties adjacent to the north of the subject right-of-way and would like to incorporate the area subject to the vacate into her property.
The Applicant has provided letters of no objection from all applicable utility companies. The proposed vacate of the subject right-of-way does not pose obstruction to other parcels and will not prohibit access to any adjacent properties; therefore, Public Works has no objection to the request.
This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Land Development Code and the authority of Sections 336.09 and 336.10, Florida Statutes.
