Background:

Design, permitting, and easement/right-of-way acquisition are ongoing for the Seminole County Public Works Midway Drainage Improvement Project (CIP 01907077).  The improvements associated with this project are the construction of storm drainage and stormwater management facilities such as drainage structures, storm drainage, and stormwater ponds.

Midway-Canaan Community Water Association (MCCWA) is a private water utility serving the Midway community that has existing water distribution facilities (pipes, valves, meters, etc.) throughout the community that are located within the County right-of-way. Several of the existing MCCWA pipes are in conflict with the proposed storm drainage of the Midway Drainage Improvement Project.  These conflicts necessitate the adjustment/relocation of existing (active) or removal of existing (inactive) MCCWA water lines.  It is considered impractical and costly to design and construct the proposed storm drainage to avoid impacts on the existing MCCWA water system.

Per Section 337.403, Florida Statutes (2024), non-Seminole County utilities located within Seminole County public right-of-way, with no dedicated easements, must adjust their utilities upon County request.  However, the MCCWA has stated to Seminole County that they do not have sufficient funding or personnel to do so.

Public Works has an existing contract with Atkins Realis, Inc. to design and permit the Midway Drainage Improvement project.  An additional work order was executed with Atkins Realis for them to design, estimate construction costs and permit the needed adjustments/relocations of the MCCWA system.

Atkins Realis, Inc. has estimated a total construction cost of $709,176.81 ($665,774.85 for “Bid Package 1”, $43,401.96 for “Bid Package 2”) for relocations, adjustments, removal, etc. of portions of the MCCWA water system needed to accommodate the Midway Drainage Improvement Project.

As part of the overall drainage improvements, MCCWA will be donating an easement, which is valued at $8,830.00, from property owned by the MCCWA.

Requested Action:

Staff requests the Board approve and authorize the Chairman to execute a Utility Relocation Agreement and Donation Agreement for the relocation of existing water utilities and the removal of abandoned water utilities owned and operated by the Midway-Canaan Community Water Association to accommodate the proposed construction of the drainage improvements associated with Seminole County’s Midway Drainage Improvements project (CIP 01907077).
