Background:

The Applicant is requesting to vacate a portion of a twenty-five (25) foot-wide platted utility and sidewalk easement along the east side of Lot 335 of the Wekiva Hunt Club Fox Hunt Section 2 Subdivision, as recorded in Plat Book 18, Pages 84 to 87 of the Public Records of Seminole County.

The area subject to the requested vacation is seven (7) feet in width by sixty-five (65) feet in length, containing approximately 455 square feet.

The purpose of the request is to accommodate for the pool in the rear yard of the property. There is an existing sidewalk approximately twelve (12) feet away from the edge of the pool screen that will remain unimpeded by the proposed vacation.

The Applicant has provided letters of no objection to the vacation of a portion of the utility easement from all applicable utility companies. County staff have no objections to the partial vacation and abandonment of the utility and sidewalk easement.

This request complies with the requirements for vacating easements under the authority of Section 35.181, Land Development Code of Seminole County, and Section 177.101 of the Florida Statutes.

Staff requests the Board adopt the Resolution vacating and abandoning a portion of a utility and sidewalk easement located on Lot 335 of the Wekiva Hunt Club Fox Hunt Section 2 Subdivision, as recorded in Plat Book 18, Pages 84 to 87 of the Public Records of Seminole County.
