Background:

In response to a complaint on December 4, 2019, the Seminole County Code Enforcement Officer commenced an investigation and observed the following repeat violation on the property located at 1067 Williams Street, Altamonte Springs: Uncultivated Vegetation, in violation of Seminole County Code, Chapter 95, Section 95.4, as defined in Section 95.3 (b), originally cited in response to a complaint on November 15, 2018. A Notice of Hearing was sent to the Respondent providing for a February 27, 2020, hearing date before the Seminole County Code Enforcement Board.

A follow up inspection was initiated by the Code Enforcement Officer on February 17, 2020, and the Officer found the violation was in compliance.

At the February 27, 2020, hearing, the Code Enforcement Board imposed an Order Reducing Fine (in Compliance), stating “that a fine in the amount of $50.00 per day would be imposed for each day the violation continued…” and the fine was ordered for a total of 72 days from December 4, 2019, through the compliance date of February 14, 2020. The total balance due on the lien was $3,600.00 and, at said hearing, the Code Enforcement Board reduced the fine to $400.00 to be paid within 60 days with the condition that, if the reduced amount was not paid, the fine would revert to the original amount of $3,600.00. The reduced fine was not paid within 60 days, and the Order was recorded as a lien in the full amount of $3,600.00. The Order was recorded in OR Book/Page 9748/1165-1166 of the Official Records of Seminole County, Florida.

On August 31, 2021, in response to a complaint, the Seminole County Code Enforcement Officer responded to the property, located at 1067 Williams Street, Altamonte Springs, and observed a second (2nd) repeat violation: Uncultivated Vegetation, in violation of Seminole County Code, Chapter 95, Section 95.4, as defined in Section 95.3 (b). A Notice of Hearing was sent to the Respondent providing for a January 27, 2022, hearing date before the Seminole County Code Enforcement Board.

At the January 27, 2022, hearing, the Code Enforcement Board imposed an Order Finding Non-Compliance and Imposing Fine/Lien on a Repeat Violation for a total amount of $7,550.00 for 151 days of non-compliance at $50.00 per day commencing on August 31, 2021, with the fine increasing on January 27, 2022, to $100.00 per day until compliance. The Order Finding Non-Compliance and Imposing Fine/Lien was recorded in OR Book/Page 10161/1521-1522 of the Official Records of Seminole County.

In March of 2024, the Clerk of the Court notified the Seminole County Code Enforcement Office Clerk of a pending Tax Sale of the subject property. Due to the recorded liens, staff completed and submitted a Tax Deed Surplus Claim to the Seminole County Clerk’s Office to request any overpayment funds resulting from the Tax Sale.

On April 4, 2024, this property’s Tax Deed was sold to Morgan Voke and Deborah R. Longstaff.

A follow-up inspection on April 5, 2024, found the violation was in compliance on the second (2nd) repeat lien. The full amount due on such lien was $87,450.00 for the dates of August 31, 2021, through April 5, 2024.

A total amount of $92,496.96 was received by the Seminole County Clerk’s Office on May 17, 2024, for the Tax Surplus Claim. Such amount was sufficient to fully satisfy both liens; $3,600.00 for the first (1st) repeat violation lien, and $87,450.00 for the second (2nd) repeat violation lien. As a result of the surplus funds, both liens are now paid in full.

Requested Action:

Staff requests the Board approve and authorize the Chairman to execute the Satisfaction of Liens, due to full payment of such, for the liens recorded in OR Book/Page 10161/1521-1522 and 9748/1165-1166 for the Code Enforcement Board Case No. 19-25-CEB. Such liens pertain to the property located at 1067 Williams Street, Altamonte Springs, Tax Parcel No. 18-21-30-509-0000-0180, previously owned by Horis Mack and currently owned by Morgan Voke & Deborah R. Longstaff.
