Background:
In accordance with Section 35.152 of the Seminole County Land Development Code (SCLDC), the Applicant is requesting Board approval of the Bonnalyn Hollow Plat. The plat contains three (3) residential lots on 20.14 acres with a Low Density Residential Future Land Use and A-1 (Agriculture) zoning which is the original zoning of the property. The Low Density Residential Future Land Use allows for four (4) dwelling units per net buildable acre, and the A-1 zoning classification requires a minimum lot size of one (1) acre exclusive of wetlands and floodplain; each lot will be a minimum of 6.71 acres. The overall site contains a total of 6.19 acres of wetlands that will be preserved in a conservation easement. The Subdivision’s net buildable acreage is 13.95 acres which will yield a density of 0.21 dwelling units per net buildable acre.
The subject property is located within the Seminole County utility service area; however, utility lines are currently not available; therefore, each lot will utilize well and septic for water and wastewater.
The site subject to this proposed Plat consists of twenty (20) acres in total. In 1991 the east ten (10) acres of the site was approved for a split into two (2) parcels as part of a larger “Five (5) Acre Development” approval; however, the property owner did not complete the split and the ten (10) acres remained under one (1) parcel. The owner would now like to implement the creation of the previously approved two (2) lots on the ten (10) acre portion and include the additional ten (10) acre parcel adjacent on the west to yield a total of three (3) lots.
Per Sec. 35.64 of the SCLDC, the subdividing of land shall be such as to provide, by means of a street or access-way, each lot with satisfactory and permanent access to an existing public street. Lots not having full frontage on a street shall have an access-way of at least twenty (20) feet in width and suitable for access by emergency vehicles. All three (3) lots will have frontage onto a private access-way known as Oak Hollow Lane, which is forty (40) feet in width and connects to the public road portion of Oak Hollow Lane directly adjacent to the west. Public Safety-Fire and Public Works have reviewed the existing forty (40) foot wide private access-way and have determined the ingress/egress to be suitable for access by emergency vehicles.
Per SCLDC Sec. 35.61, all lands included within the subdivision must be suitable for the various purposes proposed in the request for subdivision approval. Further, no subdivision plan may be approved unless the Board finds, after full consideration of all pertinent data, that the subdivision can be served adequately with such normal public facilities and services as are suitable in the circumstances of the particular case. The plat meets all applicable requirements of Chapter 177, Florida Statutes.
Per SCLDC Sec. 35.122, the Development Services Director waived the requirement of a Preliminary Subdivision Plan (PSP) due to the previous approval of the proposed lots; the Engineering of each lot will be reviewed at time of building permit. Infrastructure improvements are not proposed; therefore, a Performance Bond will not be required.
