Background:
The Applicant Bryan Clark has petitioned Seminole County to vacate and abandon a portion of an undeveloped fifty (50) foot wide public right-of-way known as Shallowford Street, of the Sanlando Springs Replat of Tract 57 Subdivision, recorded in 1954. The right-of-way area subject to the vacate request is located on the northwest side of Lot 6 and southeast of the park. The applicant is the owner of Lot 6 and the County owns the park.
The proposed vacate is for the easterly twenty-five (25) feet of Shallowford Street, abutting Lot 6 of Tract 57 of the Sanlando Springs Plat. The right-of-way to be vacated is 100.32 feet in length and the area is approximately 2,508 square feet.
The platted park is not developed and the vacate request does not include that portion of right-of-way abutting the park. Three (3) lots to the north and one (1) lot to the south that are adjacent to the park have vacated portions of right-of-way surrounding the park. The vacate request does not limit access to maintain the County-owned land. The Applicant desires to obtain more area to their lot in order to place a shed and fence on the property.
The Applicant has provided letters of no objection from all applicable utility companies and Public Works and Parks and Recreation have no objection to the requested vacate. A twenty-five (25) foot wide drainage easement over the area to be vacated is required per Public Works Real Estate Management and the Roads and Stormwater Department. The applicant is aware that no structures can be placed within the drainage easement.
This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Seminole County Land Development Code and Sections 336.09 and 336.10, Florida Statutes. Vacating the right-of-way will not affect access to adjacent properties and therefore, does not result in adjacent parcels becoming landlocked.
Requested Action:
Staff requests the Board of County Commissioners adopt the Resolution vacating and abandoning a portion of an undeveloped right-of-way known as Shallowford Street, in the Sanlando Springs Replat of Tract 57 Subdivision, as recorded in Plat Book 9, Page 49, of the Public Records of Seminole County, Florida.
