Background:
The Applicant Pooran Itwaru has petitioned Seminole County to vacate and abandon a portion of undeveloped right-of-way adjacent to the south perimeter of Lot 2 of the Jamestown Subdivision, as recorded in Plat Book 9, Pages 71 - 72 of the Public Records of Seminole County, Florida.
The portion of undeveloped right-of-way subject to this vacate request is approximately fifty-four (54) feet wide and seventy-three (73) feet in length, containing approximately 3,900 square feet. If the vacate is approved as requested, the Applicant/Owner of Lot 2 will receive the entire 3,900 square feet of vacated right-of-way and will incorporate the subject area of vacate into his property.
A portion of undeveloped right-of-way being approximately fifty-three (53) feet wide and twenty-four (24) feet in length (containing 1,274 square feet) would remain adjacent to the south perimeter of Lot 2 and the east perimeter of Lot 5 and will continue to be utilized as access to Lot 2 and Lot 5 of the Jamestown Subdivision. Lot 5 of the Jamestown Subdivision is owned by St James American Methodist Episcopal Church and is directly adjacent to the west of the area subject to the vacate. The owners of Lot 5 currently have a rezone application under review with Seminole County for the Historic Oviedo Colored School Museum PD. The property will access directly from the twenty-four (24) foot wide right-of-way that will remain intact if the vacate is approved.
The Applicant has provided letters of no objection from all applicable utility companies and Seminole County staff has no objection to the vacation and abandonment of the right-of-way as requested.
This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Land Development Code and the authority of Sections 336.09 and 336.10, Florida Statutes. Vacating the right-of-way will not affect access to adjacent properties and therefore, will not result in adjacent parcels becoming landlocked.
Requested Action:
Staff requests the Board adopt the Resolution vacating and abandoning a portion of undeveloped right-of-way known as James Drive in the Jamestown Subdivision, as recorded in Plat Book 9, Pages 71 - 72 of the Public Records of Seminole County, Florida.
