Summary
The Board of County Commissioners approved a reduced lien amount based on a request by the previous property owner. The reduced lien amount of $104,125.00 was subsequently paid by a title company.
Details
In response to a complaint on December 15, 2011, the Code Enforcement Officer observed the following violation on the property located at 1880 Ranchland Trail, Longwood, FL, in violation of Seminole County Code Chapter 40 Appendix “A" Section 105.1, work without the required permit(s) and occupying a structure as living space without an approved Certificate of Occupancy. A Statement of Violation was issued to the property owner and an initial hearing was held on July 26, 2012. At that hearing, the Code Enforcement Board found the property to be in violation and ordered a compliance date of September 27, 2012, with a fine of $250.00 per day if compliance was not met. The compliance date was extended by the Code Enforcement Board to January 24, 2013 in order to give the respondent additional time to comply.
The violation was not in compliance on January 28, 2013, which was when the Code Enforcement Officer re-inspected the property. The case was subsequently continued twice by the Code Enforcement Board in order to again provide time for the respondent to comply. On April 24, 2014, the Code Enforcement Board imposed a lien against the subject property for non-compliance. The lien imposed by the Board was in the amount of $143,500.00 for 574 days of non-compliance with a fee continuing to accrue at $250.00 per day, for each day the violation continued past April 24, 2014.
The permits necessary to remedy the subject violation, and to be in compliance, were obtained May 7, 2015 when the Code Enforcement Officer filed an Affidavit of Compliance on May 20, 2015.
A copy of the Affidavit of Compliance was mailed to the Respondent which disclosed the total lien amount due of $208,000.00.
The Board of County Commissioners heard a Request for Reduction by the applicant, Drew A. Mooty, on June 11, 2024. At that time, the Board approved a reduction from $208,000.00 to $104,125.00.
The lien in the amount of $104,125.00 was paid in full on July 9, 2024 by Golden Key Title Services.
