Background:
On July 27, 2022, Ms. Matyko (Plaintiff) was driving an automobile that was involved in a motor vehicle crash with a County-owned vehicle being operated by a Utilities Operations employee. As a result of the law enforcement investigation of the crash, the County employee received a citation for running a red light. Plaintiff claims medical bills for her alleged injuries totaling approximately $262,000. Plaintiff served her Complaint on Seminole County on March 13, 2023. At mediation on August 7, 2024, a proposed settlement agreement was reached contingent upon approval by County Manager Darren Gray and subsequent approval by the Seminole County Board of County Commissioners. On August 19, 2024, Mr. Gray approved moving the matter to an upcoming agenda to seek Board approval. As evidenced by the attached signed General Release, Plaintiff has authorized her counsel to execute a Joint Stipulation for Dismissal with Prejudice of the lawsuit to be filed with the Court by counsel upon settlement. The proposed settlement of $200,000 is inclusive of attorney’s fees and provides for a full and complete settlement of any and all claims, rights and actions whatsoever that the Plaintiff has or may have against Seminole County.
Requested Action:
Staff requests the Board approve the proposed mediated settlement of any and all claims, rights and actions whatsoever that the Plaintiff has or may have against Seminole County for the total amount of $200,000, inclusive of attorney's fees, and authorize staff and counsel to execute all necessary settlement documents.
