Background:

In 2000, eminent domain proceedings were undertaken for the East Lake Mary Bv. Extension involving property owned by the Abdulhussein Family Limited Partnership.  The result was the establishment of a county maintained retention pond and drainage easement located at 2540 E Lake Mary Bv., between the roadway and Silver Lake.  The owner retained the land and development rights surrounding the pond.  The successor owners, Mellonville Holding, LLC, are desirous now of developing the property, and in order to do so, require certain modifications to the existing easements that require approval from the Board of County Commissioners.  The agreement sets forth the maintenance and access requirements for the property owners and the County to ensure the drainage systems and maintenance access are provided for as required.  The property is located within the city of Sanford.

Requested Action:

Staff requests the Board approve and authorize the Chairman to execute the Mellonville Industrial Park Easement Agreement with Mellonville Holding, LLC related to a County maintained retention pond and drainage easement located at 2540 E Lake Mary Blvd
