Background:
On August 30, 2018, Seminole County acquired the former Rolling Hills Golf Course (Source Property). The County, in coordination with the Florida Department of Environmental Protection (FDEP), conducted a Site Assessment Update and Closure Report to assess the Source Property for containments in the soil and groundwater in and around the vicinity of the Source Property, and to establish remedial controls to abate and contain any contaminants discovered. On March 27, 2023, FDEP advised the County that remedial controls established pursuant to the Report were satisfactory and recommended implementation of institutional controls to contain and monitor any further contamination in perpetuity and to effectuate final closer of the cleanup effort. The institutional controls required by FDEP include the proposed Ordinance establishing the Rolling Hills Groundwater Monitoring District for Non-Source Properties and the Declaration of Restrictive Covenants for the Source Property (Declaration).
The area of potential contamination extends beyond the Source Property boundary and encompasses five other properties owned by third parties (Non-Source Properties). Due to the potential existence of small amount of remaining contaminant, FDEP is requiring the County to adopt an Ordinance placing conditions on the excavation of new wells, dewatering activities and construction of new stormwater facilities on the Non-Source Properties. The conditions include, but are not limited to, the requirement for Non-Source Property owners to submit a signed and sealed plan to FDEP for review and approval of all new wells, dewatering activities and new stormwater facilities. The owners of the Non-Source Properties have been advised of the proposed Ordinance and the establishment of the Rolling Hills Groundwater Monitoring District through in-person meetings with the County and via certified mail.
The Declaration of Restrictive Covenants applies to the Source Property owned by the County. The conditions and restrictions in the Declaration mirror those proposed in the Ordinance and additionally include soil engineering controls and land use restrictions. The latest round of revisions to the Declaration were submitted to FDEP on November 20, 2025 and are still in review. Should FDEP have additional changes or comments to the draft Declaration, County staff will revise accordingly and provide to the Chairman to sign. The most current draft of the Declaration is included with this agenda item and County staff does not anticipate significant changes to the draft document.
Requested Action:
Staff requests the Board approve the adoption of the Ordinance establishing Chapter 270, Part 13, Section 270.475 of the Seminole County Code, the Rolling Hills Groundwater Monitoring District, and authorize the Chairman to execute the final version of the Declaration of Restrictive Covenant for the former Rolling Hills Golf Course once received from the Florida Department of Environmental Protection.
