Background:
In accordance with Section 35.152 of the Seminole County Land Development Code (SCLDC), the Applicant is requesting Board approval of the Final Plat for the SR 46 Commercial Subdivision. The plat contains two (2) commercial lots on 11.64 acres. The subject site has a Future Land Use of Planned Development and PD (Planned Development) zoning designation. The subdivision is comprised of two (2) commercial lots and one (1) shared stormwater tract, Tract “A”. Lot 1 is proposed to have an area of approximately four (4) acres and Lot 2 is proposed to have an area of approximately 3.99 acres.
The subject property is required to connect to public utilities for water and sewer. This development is located within the City of Sanford’s utility service area; the Applicant has coordinated with the City to establish utility service and a pre-annexation agreement.
The Developer will dedicate approximately 331 square feet of property at the corner of Harvest Time Drive and SR 46 for right-of-way dedication to the County via warranty deed.
On March 11, 2025, a Small Scale Future Land Use Amendment from Higher Intensity Planned Development- Target Industry to Planned Development, and Rezone from A-1 (Agriculture) and C-1 (Retail Commercial) to PD (Planned Development) for the subject property was approved unanimously by the Board of County Commissioners. Districts 1, 2, 3, 4 and 5 voted AYE.
The Final Engineering Plans were submitted in accordance with Section 35.44 of the SCLDC and were approved on November 20, 2025.
The Final Plat meets all conditions stated in Development Order # 24-20500014, Developer’s Commitment Agreement # 25-20500007, and all applicable requirements of Chapter 35 of the SCLDC and Chapter 177, Florida Statutes.
The proposed plat does not require a performance bond because substantial infrastructure is not being proposed with this plat.
