Background:

Code Enforcement liens run in favor of the Board of County Commissioners. Currently, all satisfactions and/or releases of code enforcement liens are approved by the Board of County Commissioners thus requiring preparation of an agenda item for the Board of County Commissioners Meeting. The current process over-utilizes County staff time and resources. Staff believes the administrative process put forth in the proposed Ordinance and Resolution is a more efficient and cost-effective process for both the County and property owners.

The proposed Ordinance and Resolution will allow the County Manager or designee, to execute a satisfaction or release of lien if the lien is fully complied with and the total amount due on the lien is paid in full and cause such to be recorded by Seminole County staff. The proposed process will help to reduce time frames for real estate transactions and produce a cost savings for the County.

The proposed Ordinance amends the Seminole County Code of Ordinances, and the proposed Resolution amends the Seminole County Administrative Code.

Requested Action:

Staff requests the Board approve the Ordinance amending Ch.40 (Building and Construction), Ch. 53 (Code Enforcement), Chapter 95 (Health and Sanitation), Ch. 168 (Nuisances), and Ch. 250 (Traffic) of the Seminole County Code of Ordinances; and the Resolution creating subsection 3.20(c) in the Seminole County Administrative Code to provide a new administrative process for release of code enforcement liens when they are fully complied and paid in full.
