Background:

The Applicant has petitioned Seminole County to vacate and abandon a portion of a fifteen (15) foot wide platted drainage and utility easement along the north side of Lot 10 of the Bolling Farms Subdivision, as recorded in Plat Book 45, Pages 56 and 57 of the Public Records of Seminole County. The area subject to the requested vacate is five (5) feet in width and 21.88 feet in length, containing approximately 102 square feet.

The purpose of the request is to accommodate for the expansion of a pool deck in the rear yard of the property. The area just to the east of the area, subject to the current vacate request was previously vacated in 2001 in order to construct the existing pool decking. This request is to expand that existing pool decking to the west, thus necessitating this request.

The Applicant has provided letters of no objection to the vacation of a portion of the utility easement from all applicable utility companies.  County staff has no objections to the partial vacation and abandonment of the utility easement.

This request complies with the requirements for vacating easements under the authority of Section 35.181 of the Seminole County Land Development Code, and Section 177.101 of the Florida Statutes.

Requested Action:

Staff requests the Board adopt the Resolution vacating and abandoning a portion of a drainage and utility easement located on Lot 10 of the Bolling Farms Subdivision, as recorded in Plat Book 45, Pages 56 and 57 of the Public Records of Seminole County, Florida, for property more particularly known as 1932 Caladium Place, Longwood, Florida.
