Background:

This parcel (No. 1-858) has been identified as being needed for a drainage easement necessary for the Midway Drainage Improvement Project. The owner (Henry Colyer / Tax ID No. 33-19-31-507-0000-0810) of the property located at 3201 Midway Avenue has agreed to sell and convey this drainage easement to Seminole County for the sum of $83,150.00, inclusive of all fees and costs.

 

The parent property located at the southeast corner of Midway Avenue and Broadway Street is improved with a single-family residence and ancillary improvement and consists of 0.18± acres of land. The County’s valuation of this acquisition is $16,000.00, a portion of which includes the cost to cure to make the owner whole. The County’s incentivized offer amount was $24,780.00.  After negotiations with the owner, a settlement was reached at $83,150.00, inclusive of all fees and costs.  It should be noted that decorative columns are within the area of acquisition and were to be replaced by the County’s construction contractor.  However, the owner wanted to replace the columns himself since he constructed the existing columns.  The plans will be revised to eliminate the columns being replaced by the County to offset this additional acquisition cost. This proposed settlement amount is reasonable under the circumstances inherent in the condemnation process. The main rationale for approval of this settlement is cost avoidance.  If this acquisition must proceed to condemnation, litigation costs and the costs of the County’s appraisal and to pay for the owner’s appraisal and other attorney and expert’s fees on both sides would likely exceed the additional settlement funds proposed to be paid.

 

Requested Action:

Staff requests the Board approve and authorize the Chairman to execute a Purchase Agreement related to Project Parcel No. 1-858 for a drainage easement necessary for the Midway Drainage Improvement Project (588.95± SF) between Henry Colyer and Seminole County for $83,150.00, as full settlement and any other claim for compensation from which Seminole County might be obligated to pay relating to the parcel.
