Background:
The Applicant has petitioned the County to vacate two unnamed and undeveloped rights-of-way. The respective rights-of-way are part of different recorded plats. The right-of-way that runs north to south is part of the Sanford Celery Delta Subdivision. The requested right-of-way to be vacated in this section is approximately fifteen (15) feet in width and 1,307 feet in length with an area of 19,605 square feet. The right-of-way subject to the request that runs east to west is part of the Crippen’s Subdivision. The requested right-of-way to be vacated in this section is approximately fifteen (15) feet in width and 647.7 feet in length with an area of 9,716 square feet.
All additional owners of properties adjacent to the subject rights-of-way are included as parties to this application. The purpose of the right-of-way vacate as proposed is to accommodate the second phase of a residential development in the City of Sanford, known as Palmetto Pointe.
As proposed, the vacation includes the establishment of an access easement benefiting parcels 16-20-31-300-0040-0000, 16-20-31-300-005A-0000, 16-20-31-300-004C-0000, 16-20-31-300-004A-0000, and 16-20-31-300-0050-0000. Vacating both rights of ways would otherwise eliminate legal access via the subject rights-of-way currently associated with these parcels, thereby necessitating the access easement. Although these parcels presently gain physical access through Eagle View Cove, Eagle View Cove is privately owned and does not provide the required legal access. The access easement is fully executed by all parties and will be recorded upon approval of the requested vacate.
The proposed vacate also requires a drainage easement, as the County has a ditch within the right-of-way to the north. The drainage easement is attached and fully executed, to be recorded upon approval of the requested vacate.
The Applicant has provided letters of no objection from all applicable utility companies and Public Works has no objection to the requested vacate.
This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Land Development Code and the authority of Sections 336.09 and 336.10, Florida Statutes.
Requested Action:
