Background:

On January 9, 2020, the State of Florida, Department of Transportation (“FDOT”) and Seminole County (“County”) entered into a Joint Participation Agreement for a project known as the National Pollutant Discharge Elimination System Permit FLS000038 (“Project”) (hereinafter referred to as the “Agreement”). The purpose of the Agreement is for FDOT to provide funds to the County to share in the costs associated with the water quality monitoring program, a public education program, and solicitation of public input for identification of illicit discharges, as further set forth in the Agreement. The Agreement contemplates FDOT providing County an amount equal to $8,356.00 per FDOT Fiscal Year beginning 2019/2020 through 2023/2024, for a total of $41,780.00. The term of the Agreement contemplates completion of the Project by October 31, 2025. Supplemental Agreement No. 01 was approved by the Board on May 13, 2025, for an additional $8,356.00 for FDOT Fiscal Year 2024/2025.

The FDOT has requested to increase funding under the Agreement for an additional FDOT Fiscal Year (2025/2026) in the amount of $8,356.00, increasing the total under the Agreement to $58,492.00 for actual Project costs incurred. In addition, FDOT and the County are mutually agreeable to extend the term of the Agreement for completion of the Project by October 31, 2027.

Requested Action:

Staff requests the Board approve and authorize the Chairman to sign the Supplemental Agreement No. 02 to the Joint Participation Agreement between the State of Florida, Department of Transportation and Seminole County for NPDES Permit FLS000038, the accompanying Resolution, and  any potential subsequent supplemental agreements and resolutions.
