Background:
Applicants Kimberlee Frank and Linda Van Marter have petitioned the County to vacate and abandon a platted, unconstructed portion of an unnamed right-of-way lying between Lot 28 of the M.M. Lord’s First Addition to Citrus Heights Subdivision as recorded in Plat Book 3, Page 87, and Lot 6 of Rector’s Revision of a part of M.M. Lord’s First Addition to Citrus Heights Subdivision as recorded in Plat Book 10, Page 5, of the public records of Seminole County, Florida.
The area to be vacated is twenty (20) feet wide and 135 feet in length, having an area of approximately 2,700 square feet. Applicant, Kimberlee Frank, owns Lot 28 of M.M. Lord’s First Addition to Citrus Heights Subdivision; therefore, the south half of the subject area to be vacated that is abutting the north property line of Lot 28 (being 127 feet in length with an area of 1,270 square feet) will be incorporated into Lot 28. Applicant Linda Van Marter owns Lot 6 of Rector’s Revision of a part of M.M. Lord’s First Addition to Citrus Heights Subdivision; therefore, the remaining portion of the subject vacate (being135 feet in length with an area of 1,430 square feet) abutting the south property line of Lot 6, will be incorporated into Lot 6. The division of the subject vacate is further illustrated in the attachment titled “Conveyance of Proposed Vacate”.
The Applicants have provided letters of no objection from all applicable utility companies. The proposed vacate of the subject right-of-way does not pose obstruction to other parcels and will not prohibit access to any adjacent properties; therefore, Public Works has no objection to the request.
This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Land Development Code and the authority of Sections 336.09 and 336.10, Florida Statutes.

Staff requests the Board adopt the Resolution vacating and abandoning an uncut portion of an unnamed public right-of-way, as recorded in Plat Book 3, Page 87, of the Public Records of Seminole County, Florida.
