Background:

In accordance with Section 35.152 of the Seminole County Land Development Code (SCLDC), the Applicant is requesting Board approval of the Final Plat for the Tered Estates Subdivision. The plat contains three (3) lots on 5.35 acres. The subject property has a future land use designation of Suburban Estates and A-1 (Agriculture) zoning, which allows a maximum density of one (1) dwelling unit per one (1) net buildable acre with a minimum lot size of one (1) acre and minimum lot width of 150 feet.

The site contains approximately 0.31 acres of wetlands and is located within the Wekiva River Protection Area, which requires a twenty-five (25) foot minimum, fifty (50) foot overall average upland buffer. 

The site is located within the Sunshine Water utility service area; however, utilities are not available; therefore, the subdivision will utilize well for water and septic for wastewater.

 

All three (3) lots have direct access onto Delk Road; however, Lot 2 and Lot 3 will access via a shared access easement to be owned and maintained by the property owners.

 

In accordance with Section 35.13 of the Seminole County Land Development Code (SCLDC) on June 7, 2023, the County’s Planning and Zoning Commission reviewed and voted unanimously to approve the Preliminary Subdivision Plan for Tered Estates. Final Engineering is not required as part of the subdivision process since there is no infrastructure required for the newly created lots.

The Applicant has provided all required submittals as per Section 35.44 of the SCLDC. Staff has reviewed the required submittals and finds that the request is in compliance with all applicable provisions of Chapter 35 of the SCLDC, Chapter 177, F.S. and the land use zoning designation of the property.

Staff requests the Board approve the Final Plat for the Tered Estates Subdivision containing three (3) lots on 5.35 acres zoned A-1 (Agriculture), located at the corner of Delk Road and Michael Drive.
