Background:

The Applicant has petitioned the County to vacate and abandon a portion of Chapman Rd located approximately ¼ mile west of W SR 426. The portion of right-of-way subject to this vacate request is located along the south perimeter of Lot 50 and Lot 55, and the north perimeter of Lot 51 and Lot 54, of the Slavia Colony Cos Subdivision, as recorded in Plat Book 2, Page 71 of the Public Records of Seminole County Florida.

The subject right-of-way is thirty (30) feet wide and approximately 1,074 feet in length; if the vacate is approved fifteen (15) feet will be allocated to the north property and fifteen (15) feet will be allocated to the south property. However, the owners of Lot 50 and Lot 55 (FDOT) have decided to sell their vacated portion of the Chapman Road right-of-way to the owner of Lot 51 and Lot 54 (LG Development Corporation). As part of private sale of the right-of-way vacate, FDOT will retain a perpetual easement with LG Development Corporation to ensure continued access to its existing stormwater ponds on Lot 50 and Lot 55.

The Applicant has provided letters of no objection from all applicable utility companies and Public Works has no objection to the requested vacate.

This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Seminole County Land Development Code and the authority of Sections 336.09 and 336.10, Florida Statutes. Vacating the right-of-way will not affect access to adjacent properties and therefore, does not result in adjacent parcels becoming landlocked.

Requested Action:

Staff requests the Board of County Commissioners adopt the Resolution vacating and abandoning a portion of public right-of-way known as Chapman Rd, in the Slavia Colony Cos Subdivision, as recorded in Plat Book 2, Page 71, of the Public Records of Seminole County, Florida.
