Background:
Applicants Joshua Lewis and Sara Lewis have petitioned the County to vacate and abandon a platted, unimproved portion of a public right-of-way known as Panther Street, formerly known as Artesia Avenue, of the Van Arsdale Add to Black Hammock Plat, as recorded in Plat Book 1, Page 31, of the Public Records of Seminole County, Florida. The portion of right-of-way subject to this vacate request is twenty-five (25) feet wide and 672.6 feet in length, adjacent to the south perimeter of Lot 144, leaving approximately 607 feet of public right-of-way to remain. The area of the proposed vacate is approximately 16,815 square feet. The property directly adjacent to the south of the area subject to the vacate request, known as 980 Elm Street, is not part of the Van Arsdale Add to Black Hammock Plat; therefore, the property owners of Lot 144 will acquire the entire twenty-five (25) feet if vacated.
The Applicant wishes to retain the existing fence and driveway which currently exist in the right-of-way. The granting of the right-of-way vacate would allow for the fence structures to remain.
The Applicant has provided letters of no objection from all applicable utility companies and Public Works has no objection to the requested vacate. At the request of Duke Energy and Seminole County, a twenty-five (25) foot wide utility and drainage easement has been provided over the area subject to the vacate request.
This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Land Development Code and the authority of Sections 336.09 and 336.10, Florida Statutes.
