Background:
The Applicant has petitioned the County to vacate and abandon an undeveloped portion of an unnamed alley right-of-way in the Lockhart’s Subdivision, as recorded in Plat Book 3, Page 70, of the Public Records of Seminole County, Florida. The portion of right-of-way subject to this vacate request is fifteen (15) feet in width, being 85.67 feet in length along the east perimeter of Lot 9, Block 1, and 115.17 feet in length along the west perimeter of Lots 10, 11, and 12 of Block 1, of the Lockhart’s Subdivision. The total area subject to the vacate request is approximately 1,506.27 square feet.
The applicant is the owner of Lots 9, 10, 11, and 12 and proposes to unify the parcels if the vacate is approved.
The vacate request originated as a code violation from June 27, 2024, due to the gate structures being installed in the alley right-of-way. It was also found that a portion of the A.C. unit pad is encroaching into the right-of-way. The unification of the lots and the inclusion of the area subject to the vacate request will rectify the code violation.
The Applicant has provided letters of no objection from all applicable utility companies and Public Works has no objection to the requested vacate.
This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Land Development Code and the authority of Sections 336.09 and 336.10, Florida Statutes.

Staff requests the Board adopt the Resolution vacating and abandoning a portion of an unnamed, undeveloped right-of-way in the Lockhart Subdivision, as recorded in Plat Book 3, Page 70, of the Public Records of Seminole County, Florida.
