Background:
The Applicants have petitioned Seminole County to vacate a portion of a fifteen (15) foot wide platted drainage and utility easement along the north perimeter of Lot 15 of the Forrest Creek Estates Subdivision, as recorded in Plat Book 32, Pages 53-54 of the Public Records of Seminole County, Florida. The subject drainage and utility easement was originally platted as a twenty-five (25) foot wide access, drainage, and utility easement; however, in 1992 Seminole County adopted Resolution #92-R-258 vacating and abandoning the entire twenty-five (25) foot wide access easement along with the south ten (10) feet of the north twenty-five (25) foot wide drainage and utility easement, leaving the north fifteen (15) feet of Lot 15 still encumbered by the drainage and utility easement.
The area subject to the vacate request is a portion of the south five (5) feet of the north fifteen (15) feet of Lot 15, being ninety-one (91) feet in length, for a total of 455 square feet. The Applicant is requesting the partial drainage and utility easement vacate to allow for a pool and deck to encroach five (5) feet into the remaining fifteen (15) foot wide easement, leaving ten (10) feet of the easement to remain intact.
The Applicant has provided letters of no objection from all applicable utility companies and Seminole County staff has no objections to the partial vacation and abandonment of the drainage and utility easement as requested.
This request complies with the requirements for vacating easements under the authority of Section 35.181, Land Development Code of Seminole County, and Section 177.101 of the Florida Statutes.
