Background:
On December 12, 2023, the Seminole County Board of County Commissioners authorized transmittal to the State of the EAR-Based Amendments to the Seminole County Comprehensive Plan. Attached are the motion and minutes for reference. The EAR-based amendments were then transmitted within ten days of the public hearing to be reviewed by the Department of Commerce and other State and regional review agencies. Staff received response letters from the Department of Commerce and the Florida Department of Agriculture and Consumer Services on December 27, 2023, and January 22, 2024, respectively. Attached are the letters for reference.
EAR & EAR Based Amendments History:
On October 4, 2023, a work session was held for the Seminole County Land Planning Agency. Under Section 7.2 of the Seminole County Land Development Code, it is the responsibility of the Seminole County Local Land Planning Agency to monitor and oversee the effectiveness and status of the Comprehensive Plan of the County and recommend to the Board of County Commissioners such changes in the Comprehensive Plan from time to time as may be required.
The Board of County Commissioners held three other work sessions on the EAR-Based Amendments. The first work session occurred at the Board of County Commissioners meeting on August 8, 2023. The second took place on September 12, 2023, and the third on October 10, 2023.
A community meeting was held on August 17, 2023. Approximately sixteen citizens, as well as staff and consultants, were in attendance. A presentation was given by the Planning Manager, who provided a detailed overview of the EAR-Based Amendments along with the goals and objectives of the Seminole County Comprehensive Plan. The public then had time to ask questions in an open forum. Afterward, the public had the opportunity to break out to five different stations with visual displays detailing various aspects of the presentation. Staff and consultants were on hand to answer questions at each station. Staff encouraged attendees to fill out comment cards or e-mail the project manager any comments.
Section 163.3191, Florida Statutes, requires the adoption of a progress report called the “Evaluation and Appraisal Report” (EAR) for all local comprehensive plans every seven (7) years. Seminole County’s most recent EAR, “Seminole County Evaluation and Appraisal Report 2022”, was authorized for transmittal by the Board of County Commissioners on November 15, 2022. This report approved and incorporated results from the public visioning process known as the “Envision Seminole 2045 Plan,” which included five vision goals: 1) protect wildlife, 2) maintain rural places, 3) grow walkable, 4) get active, and 5) be green. Each goal came with strategies and recommendations relating to the Comprehensive Plan and the Comprehensive Plan and linked to some elements of the Comprehensive Plan that were updated with the EAR.
On November 23, 2022, the “Seminole County Evaluation and Appraisal Report 2022” was found ‘sufficient’ by the Florida Department of Economic Opportunity, now called the Florida Department of Commerce.
Kimley-Horn project consultants assisted with the EAR-based amendment process. Throughout the process, the Planning and Development Division and its consultants gathered data, reviewed policies, and incorporated feedback and input from pertinent Seminole County Departments.
On December 6, 2023, the Seminole County Local Land Planning Agency recommended transmitting the proposed EAR-Based amendments to the Seminole County Comprehensive Plan to the Board of County Commissioners. The LPA/P&Z recommendation and minutes are attached for reference.
The EAR-Based Amendments include proposed text and exhibit amendments to the Capital Improvements, Conservation, Drainage, Future Land Use, Housing, Implementation, Intergovernmental Coordination, Introduction, Potable Water, Preface, Property Rights, Public School Facilities, Recreation and Open Space, Sanitary Sewer, Solid Waste, and Transportation Elements.
The Future Land Use Element is being repealed and replaced, and a copy of this element can be found in an attachment to the Ordinance as Exhibit “A,” along with the amended Future Land Use exhibits. A strike-through and underline format for the Future Land Use element is provided for reference as a separate attachment to the agenda. The other elements have been amended and reflected through a strike-through and underlined format as an attachment to the Ordinance as Exhibit “B.”
