Background:
These subject drainage easements have been identified as being needed for the Midway Drainage Improvement Project. These drainage easements will allow for the construction of a closed drainage system of pipes and improved outfalls to alleviate known flooding in the Midway community during times of extremely heavy rain events.
These drainage improvements were identified in the Midway Basin Study that was completed and approved by the Board of County Commissioners in 2021. The Midway Drainage Improvement Project currently is in the final design and permitting stage.
To date, there are a total of 147 drainage easements to be acquired to implement the needed drainage improvements. However, of the 147 drainage easements, 20 have been identified as having no encumbrances or title matters to resolve. Thus, the acquisition of these 20 drainage easements can be accomplished without the need to resolve these various encumbrances and title matters. Since time is of the essence for this project, it is important that we move to obtain the needed drainage easements as quickly as possible. The values were derived using an Agent Price Estimate of probable sale prices and the offer amount includes an incentive amount based on the Florida Department of Transportation Right-of-Way Manual regarding property acquisition, that has also been approved by the Federal Highway Administration. Therefore, approval is being requested to authorize the chairman to execute the subject Purchase Agreements to accompany our offers of compensation to the property owners. This approval will allow for the Clerk’s office to provide checks in the amount of the approved Purchase Agreements. Should an owner accept our initial offer, we would be able to obtain their signature on the Purchase Agreement and the easement and provide the compensation by check. If the initial offer is not accepted at that time and a counteroffer is made, the Purchase Agreement would need to be revised and would have to come back to the Board for approval at a later date.
Requested Action:
