Background:

On September 13, 2022, the Board of County Commissioners authorized a  Memorandum of Understanding with JES Consulting Property 5, LLC (Owner) to reimburse the Owner for additional sewer work requested by the County.

The County owns and maintains residential lift stations in perpetuity. When reviewing plans for new developments, the County attempts to reduce the number of lift stations being added into our system to reduce the cost and risk associated with sewer lift stations. This approach is supported by the County’s Comprehensive Plan.

The Owner’s original plan was to install their own sanitary sewer lift station to serve Sylvan Estates. The County responded by informing the Owner that their lift station design would need to include flows from the adjacent subdivisions to avoid having two county-owned lift stations in the same vicinity. After reviewing the most cost-effective options with the County, the Owner agreed to design and install a gravity piping system to the County’s existing Buckingham Lift Station; eliminating the need for an additional county-owned lift station for Sylvan Estates and the existing problematic lift station at Lake Sylvan Oaks.

Within the subject MOU, the County agreed to reimburse the Owner for the costs of the additional sewer construction beyond the Engineering Estimate of construction costs of the Owner’s original plans and lift station.

The original approval included $120,000 for construction plus 10% for contingencies bringing the total to $132,000. However, during construction, conditions were encountered that resulted in cost overruns. Specifically, the Owner was required to remove muck, unsuitable soils, and replace these materials with backfill soils that met the County’s specifications. County staff has worked with the Owner to verify a total project cost of $167,906.32; necessary to complete the project. This represents $35,906.32 over the original total approved by the Board.

Requested Action:

Staff requests the Board of County Commissioners approve and authorize the Chairman to execute the First Amendment to the Memorandum of Understanding with JES Consulting Property 5, LLC, increasing the total cost by $35,906.32 to $167,906.32.
