Background:
The applicant is requesting to vacate a platted 25 foot bridle path easement in sections 4 through 7 of the Spring Valley Farms Subdivision, as recorded in the Public Records of Seminole County, Florida in Plat Book 14, Pages 84-85, Plat Book 15, Pages 9 and 20. The Spring Valley Farms subdivision is located south of SR 436, east of SR 434, and west of Wymore Road in unincorporated Altamonte Springs in County Commission District 3.
The applicants, Colleen and Kevin Bano, originally submitted a petition to vacate the easement on their individual property in April 2023. Another applicant also petitioned to vacate the same easement on their individual property in April 2023. After reviewing the requests, Staff recognized the easement is not maintained and is no longer in operation. Further, the properties are zoned R-1AAA which is a zoning district that does not permit the keeping of horses.
Since the easement is not in operation, the County Attorney’s Office recommended the exploration of vacating the entire easement within the Spring Valley Farms Subdivision, rather than on an individual basis. Thus, Staff presented that option to the Board of County Commissioners to seek consensus and direction to proceed with vacation of the entire easement.
Seminole County Planning Staff is processing this request on behalf of the petitioners Colleen and Kevin Bano.
The Spring Valley Farms subdivision consists of ten (10) platted sections.
• Sections 1 and 2 do not include a bridle path easement.
• Sections 3 and 8 include a combined bridle path and utility easement.
• Sections 4 through 7 include a bridle path easement.
Based on a review of the aerial maps, multiple properties that abut the easement have existing fences within the easement, and there may also be accessory structures that encroach.
Seminole County staff held a community meeting on January 11, 2024 to gather input from affected property owners. Six property owners attended the meeting in support. No opposition from the community has been indicated as of this time.
County Staff has no objections to the vacation and abandonment of the bridle path easement.
Due to the utility easement in sections 3 and 8, staff has not included these two plat sections of the Spring Valley Farms subdivision in this request. Staff recommends vacating the entire bridle path easement in sections 4 through 7 of the plat.
This request complies with the requirements for vacating easements under the authority of Section 35.181, Land Development Code of Seminole County, and Section 177.101 of the Florida Statutes.
Requested Action:
Staff requests the Board approve and authorize the Chairman to execute a Resolution vacating and abandoning the 25 foot bridle path easement in sections 4 through 7 of the Spring Valley Farms Subdivision, as recorded in the Public Records of Seminole County, Florida in Plat Book 14, Pages 84-85, Plat Book 15, Pages 9 and 20.
